Student Visa ART Reviews Are Now Decided on the Papers. Here Is What Migration Agents Need to Know.
Published 30 May 2026 | Jan Karel Bejcek, MARN 0965239
From 1 June 2026, most Subclass 500 ART review applications are assessed without an oral hearing. The Migration Amendment (Administrative Review of Student Visa Refusal Decisions) Regulations 2026 (F2026L00640) registered on 29 May 2026 and implements the paper-based review framework that was legislated earlier this year under the Administrative Review Tribunal and Other Legislation Amendment Act 2026.
This is not a procedural tweak. It changes the fundamental nature of how student visa refusals are contested. The written submission now has to carry all the weight that oral evidence and direct Tribunal engagement used to carry.
What the Regulations Do
The default: on the papers
Student visa refusal reviews under Division 4A of the Migration Act now proceed on the papers by default. The Tribunal considers written submissions and documentary evidence. It does not hold a hearing. It does not invite the applicant to appear. This is the standard track for Subclass 500 matters from 1 June 2026.
The PIC exceptions
A matter is excluded from the on-papers pathway where the grounds for refusal relate, in whole or in part, to any of the following Public Interest Criteria:
PIC 4014 | PIC 4017 | PIC 4018 | PIC 4020
A Special Return Criterion under new sub-regulation 4.18(2) also falls outside the on-papers default. Where none of these apply, the matter proceeds on the papers. The list is exhaustive.
The 28-day response window
Under section 367F of the Migration Act, the Tribunal must invite the applicant to provide submissions and evidence addressing the refusal grounds and any relevant visa criteria. Applicants have 28 days from the date of that notice to respond. There is no mechanism to extend the statutory timeframe. Failure to respond within 28 days results in mandatory dismissal of the review application.
A separate 14-day window applies to section 367G notices (requests for further information). Responses received after the 14-day period may still be taken into account if they arrive before the final decision, but that remains at the Tribunal’s discretion.
Transitional arrangements
The new framework applies to:
- Review applications lodged on or after 1 June 2026
- Applications lodged before 1 June 2026 where the ART President has not yet directed member constitution under section 37 of the Administrative Review Tribunal Act 2024
Where a matter has already been constituted under the previous framework, the old provisions continue to apply. Steps already taken under previous provisions are treated as steps taken under the new framework for transitional matters.
What This Means for How Agents Prepare
The hearing used to do significant work that agents rarely had to explicitly account for in writing. It allowed real-time responses to Tribunal concerns. It gave clients with limited English a channel through an interpreter. It permitted agents to address credibility issues directly. None of that is available in an on-papers review.
The submission now has to anticipate and address all of that in advance. That requires a different preparation approach.
Address all relevant visa criteria, not just the refusal grounds
The Regulations require submissions to address not only the reasons for refusal but all relevant visa criteria the Tribunal may consider. A submission that only responds to the delegate’s stated concerns is not enough. Agents need to identify every criterion applicable to the subclass, assess which are potentially in issue, and address them proactively.
Write for a reader who cannot ask questions
Ambiguity in a written submission stays ambiguous. There is no hearing at which a Tribunal member can ask for clarification. Every assertion in the submission needs to be supported. Every gap in the evidence needs to be explained or filled before the submission is filed.
Calendar the 28 days from the notice date
The deadline runs from the date on the section 367F notice, not from receipt or from when your client brings it to your attention. Build internal review milestones into that window. A submission drafted on day 27 under pressure is not the same as one prepared over three weeks with a structured evidence file.
Review your ART matter templates
If your submission template and matter workflow were built around a hearing process, they need to be updated. The standard preparation checklist for an ART matter changed on 1 June 2026. That change should be reflected in how you open, structure, and manage these files.
The Regulatory Record
The instrument is F2026L00640: Migration Amendment (Administrative Review of Student Visa Refusal Decisions) Regulations 2026, registered 29 May 2026, commencing 1 June 2026. It is made under the Migration Act 1958 and amends the Migration Regulations 1994. It is available in full on the Federal Register of Legislation.
The parent legislation is the Administrative Review Tribunal and Other Legislation Amendment Act 2026, which received Royal Assent on 9 February 2026 and commenced 18 May 2026.
