For all the migration agents: we have noticed a growing trend in refusals of Subclass 407 Training Visa applications, particularly the applicants’ genuine temporary stay (GTE) intentions in relation to their nominated training program.
What are the key issues?
- Increased scrutiny of the Genuine Temporary Entrant (GTE) requirement, especially for applicants who have been in Australia for 5+ years.
- Training plans clearly identifying the gaps for training or lacking sufficient technical detail
- Already skilled applicants are suited for a Subclass 482 Visa pathway using the training visa pathway with lower wages.
Recommended Actions:
- Carefully review all pending and recent 407 visa applications.
- Ensure the GTE statement is strong, clear, and well-justified, providing clear and detailed information on how the training will help the applicant in their future.
- Provide a detailed, technical training plan that genuinely aligns with the applicant’s background and clearly demonstrates the need for their skill development.
Providing detailed information in relation to the applicant’s training is the key to successful outcomes under the department’s increasingly strict assessment approach.
