A new instrument was registered today. Worth a read if you advise on student visas – the Migration (Visas that Preclude a Person from Lodging a Student Visa Application in Australia) Instrument 2026. LIN 26/068.
It starts tomorrow, 25 September.
There is no transition period.
The affected visas are:
- Subclass 403, Domestic Worker (Diplomatic or Consular) only
- Subclass 485, Temporary Graduate
- Subclass 600, Visitor
- Subclass 601, ETA
- Subclass 602, Medical Treatment
- Subclass 651, eVisitor
- Subclass 771, Transit
- Subclass 988, Maritime Crew
- Subclass 995, Diplomatic (Temporary), primary holder only
What to expect:
- Clients on a visitor visa, ETA or eVisitor must lodge any new applications offshore.
- Temporary Graduate holders are on the list too, in any stream.
- No extensions to student, partner or work visas while in Australia for those visas.
It is practical to check the VEVO conditions of all visas if you have not been doing so.
