{"id":17679,"date":"2026-03-10T19:51:18","date_gmt":"2026-03-10T19:51:18","guid":{"rendered":"https:\/\/www.educli.com\/resources\/?p=17679"},"modified":"2026-03-10T19:51:19","modified_gmt":"2026-03-10T19:51:19","slug":"a-significant-change-to-the-subclass-407-training-visa","status":"publish","type":"post","link":"https:\/\/www.educli.com\/resources\/a-significant-change-to-the-subclass-407-training-visa\/","title":{"rendered":"A Significant Change to the Subclass 407 Training Visa"},"content":{"rendered":"\n<p>A significant change to the <strong>Subclass 407 Training Visa<\/strong> came into effect on <strong>11 March 2026<\/strong>.<\/p>\n\n\n\n<p>While it may appear procedural, the change could significantly affect how this visa pathway is used, particularly for applicants already in Australia.<\/p>\n\n\n\n<p>The <strong>Training visa (SC407)<\/strong> allows a person to come to Australia for <strong>occupational training or professional development<\/strong>, usually for up to <strong>two years<\/strong>.<\/p>\n\n\n\n<p>It is commonly used for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>workplace-based occupational training<\/li>\n\n\n\n<li>professional development programs<\/li>\n\n\n\n<li>capacity building for overseas employees<\/li>\n<\/ul>\n\n\n\n<p>Unlike employer-sponsored work visas, the <strong>407 visa is not designed as a work visa<\/strong>, but as a <strong>structured training program intended to improve professional skills<\/strong>.<\/p>\n\n\n\n<p>Prior to <strong>11 March 2026<\/strong>, the three key applications could be lodged <strong>simultaneously<\/strong>. From <strong>11 March 2026<\/strong>, visa applicants <strong>can no longer lodge a visa application while sponsorship and nomination are still pending<\/strong>.<\/p>\n\n\n\n<p>Under the new rules:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The organisation must first be <strong>approved as a Temporary Activities Sponsor<\/strong><\/li>\n\n\n\n<li>The <strong>training nomination must be approved<\/strong><\/li>\n\n\n\n<li>Only then can the <strong>visa application be lodged<\/strong><strong><br><\/strong><\/li>\n<\/ol>\n\n\n\n<p>In simple terms: <strong>Sponsorship and nomination must now be approved before the visa application can be submitted.<\/strong><\/p>\n\n\n\n<p>For applicants already in Australia, the change creates a <strong>practical timing risk<\/strong>.<\/p>\n\n\n\n<p>Current processing times for <strong>Subclass 407 visas can be up to 11 months<\/strong>. Because the visa application can now only be lodged <strong>after sponsorship and nomination approval<\/strong>, some applicants may face situations where <strong>their current visa expires before they are able to lodge the 407 application<\/strong>, leaving limited bridging options.<\/p>\n\n\n\n<p>The government has framed the change as a measure to <strong>protect program integrity<\/strong>.<\/p>\n\n\n\n<p>The Department has observed increasing cases where the visa was used <strong>for purposes other than genuine occupational training<\/strong>, including attempts to extend onshore stay or maintain lawful status when other migration pathways were not available.<\/p>\n\n\n\n<p>In reality, the <strong>407 visa has increasingly been used as a \u201cholding visa\u201d<\/strong> in migration strategies.<\/p>\n\n\n\n<p>In practice, this sometimes involved:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>using the visa to <strong>extend stay after student visas<\/strong><\/li>\n\n\n\n<li><strong>weak or poorly structured training programs<\/strong><\/li>\n\n\n\n<li>training arrangements that <strong>closely resembled regular employment<\/strong><\/li>\n<\/ul>\n\n\n\n<p>As scrutiny increased, refusals have also become more common.<\/p>\n\n\n\n<p>This change also fits within a broader shift across the migration program.
