Under the latest ESOS and National Code amendments<\/strong>, agent commissions are no longer treated as just a commercial arrangement. They are now viewed as a regulatory integrity issue<\/strong>. The biggest compliance risk right now is not recording those correctly.<\/p>\n\n\n\n

From 31 March 2026, commissions for most onshore student transfers are banned.<\/strong><\/p>\n\n\n\n

In simple terms, commissions are now seen as:
\u2022 a risk signal<\/strong>
<\/strong>\u2022 a behavioural incentive<\/strong>
<\/strong>\u2022 a compliance issue<\/strong><\/p>\n\n\n\n

If a student has already commenced with another provider and is recruited onshore to yours, paying commission will generally not be allowed<\/strong>.<\/p>\n\n\n\n

This has major implications for:
\u2022 cookery and trade pathways
\u2022 onshore conversion models
\u2022 \u201crescue transfer\u201d recruitment
\u2022 agent commission structures<\/p>\n\n\n\n

Going forward, regulators will expect providers to answer simple questions:<\/p>\n\n\n\n

\u2022 Why was this commission paid?
\u2022 What behaviour did it incentivise?
\u2022 Was the student already studying elsewhere?
\u2022 Is it consistent with your agent agreement?<\/p>\n\n\n\n

If the answer is \u201cthat\u2019s how we\u2019ve always done it\u201d<\/strong>, that won\u2019t be enough anymore.<\/p>\n\n\n\n

The reality is simple: Commissions are now a governance decision, not just a finance decision.<\/strong><\/p>\n\n\n\n
