It\u2019s a <strong>compliance requirement.<\/strong><\/p>\n\n\n\n<p>Under the updated ESOS \/ National Code framework:<br>-&gt; If a student has <strong>already commenced study onshore<\/strong>, the receiving provider is <strong>prohibited<\/strong> from paying <em>any<\/em> commission for recruiting that student<br>-&gt; Cancelling enrolment or reissuing a CoE does <strong>not<\/strong> reset this<br>-&gt; Course name doesn\u2019t matter, the <strong>provider listed on the visa CoE does<\/strong><strong><br><\/strong>-&gt; Non-monetary \u201cworkarounds\u201d (bonuses, services, gifts, marketing support) must be also captured<\/p>\n\n\n\n<p>There are a few exceptions:<br>&#8211; Courses are packaged at the time of application for visa<br>&#8211; Progression changes within that package<br>&#8211; Compassionate and\/or compelling reasons<\/p>\n\n\n\n<p>The reform is a deliberate attempt to stop onshore student poaching.&nbsp;<\/p>\n\n\n\n<p>It removes incentives for unnecessary transfers and forces providers to own the recruitment practices and support it with evidence.<\/p>\n\n\n\n<p>The real risk for providers in 2026 isn&#8217;t, &#8220;Are we paying commissions?\u201d<\/p>\n\n\n\n<p>It\u2019s:<\/p>\n\n\n\n<p>\u201cCan we explain <em>why<\/em> we paid this commission when asked?\u201d<\/p>\n\n\n\n<p>If your answer relies on \u201cthat\u2019s how we\u2019ve always done it\u201d, you should review your strategies.&nbsp;<\/p>\n\n\n\n<p>Commissions are now a <strong>governance issue,<\/strong> and providers who start early will be fine.
