{"id":16896,"date":"2026-02-02T21:54:55","date_gmt":"2026-02-02T21:54:55","guid":{"rendered":"https:\/\/www.educli.com\/resources\/?p=16896"},"modified":"2026-03-02T00:09:55","modified_gmt":"2026-03-02T00:09:55","slug":"it-is-not-an-agent-problem-its-a-system-problem","status":"publish","type":"post","link":"https:\/\/www.educli.com\/resources\/it-is-not-an-agent-problem-its-a-system-problem\/","title":{"rendered":"It is not an \u201cagent problem\u201d; it\u2019s a system problem"},"content":{"rendered":"\n<p>The recent submission by the Association of Australian Education Representatives in India (AAERI), highlighted by The Koala News, puts a spotlight on a structural weakness that many providers, recruiting from the subcontinent, have quietly inherited over the last decade \u2013 an <strong>opaque recruitment chain built on aggregators and largely invisible sub-agents<\/strong>.<\/p>\n\n\n\n<p>India&#8217;s return to the highest risk level has made the concept of &#8220;not knowing who is recruiting on your behalf&#8221; increasingly problematic.<\/p>\n\n\n\n<p>AAERI\u2019s submission makes a simple but uncomfortable point: while institutions may contract with an aggregator, <strong>the real recruitment activity often happens several layers downstream<\/strong>, by individuals who are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>not directly contracted<\/li>\n\n\n\n<li>not trained by the provider<\/li>\n\n\n\n<li>not visible in institutional records<\/li>\n\n\n\n<li>and often not monitored at all<br><\/li>\n<\/ul>\n\n\n\n<p>Enters the ESOS Act amendment on 5 December 2025 introducing new expectations for recruitment and documentation practices, especially around agent activities. Under <strong>Standard 4 of the National Code<\/strong> and <strong>Section 21A of the ESOS Act<\/strong>, providers remain accountable for <em>all<\/em> agents acting <strong>directly or indirectly<\/strong> on their behalf.<\/p>\n\n\n\n<p>That accountability chain is only as strong as the system supporting it. The concern isn\u2019t simply about non-compliance. It\u2019s about <strong>misaligned incentives<\/strong>.<\/p>\n\n\n\n<p>Aggregator models are, by design, volume-driven. Speed and scale often take priority over student suitability, documentation quality, and long-term outcomes. In higher-risk markets, this creates the perfect conditions for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>inconsistent advice<\/li>\n\n\n\n<li>undisclosed fees<\/li>\n\n\n\n<li>misrepresentation at education fairs<\/li>\n\n\n\n<li>and, increasingly, visa integrity issues<br><\/li>\n<\/ul>\n\n\n\n<p>The submission also raises a critical operational reality that many providers are already feeling: <strong>How do you publicly list and monitor sub-agents if you don\u2019t actually know who they are?<\/strong><\/p>\n\n\n\n<p>This is where the conversation needs to shift. Moving away from trust-based assumptions and towards <strong>system-based oversight<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>knowing exactly who is recruiting<\/li>\n\n\n\n<li>where they sit in the chain<\/li>\n\n\n\n<li>what information they provide<\/li>\n\n\n\n<li>and who are their clients<br><\/li>\n<\/ul>\n\n\n\n<p>This is why <strong>agent management can no longer live in spreadsheets, inboxes, or ad-hoc declarations<\/strong>.<\/p>\n\n\n\n<p>Modern agent ecosystems require:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>clear mapping of agents <em>and<\/em> sub-agents<\/li>\n\n\n\n<li>contract and training visibility<\/li>\n\n\n\n<li>application-level attribution<\/li>\n\n\n\n<li>performance and risk signals that surface early, not during an audit<br><\/li>\n<\/ul>\n\n\n\n<p><strong>If your recruitment model can\u2019t be clearly explained, evidenced, and defended, the risk now sits with the provider.<\/strong><\/p>\n\n\n\n<p>From 2026, regulators won\u2019t be asking <em>whether<\/em> you trust your agents.
