These changes tighten oversight, close long-standing loopholes, and increase transparency across the sector.&nbsp;<\/p>\n\n\n\n<p>The ESOS Act now defines an education agent based on activities, not contracts.<br><\/p>\n\n\n\n<p>This means any entity, individual, or business performing recruitment, counseling, advice, marketing, PRISMS work, fee collection, or \u201cotherwise dealing with overseas students\u201d on behalf of a provider is considered an education agent, even if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There is no written agreement<\/li>\n\n\n\n<li>They are a contractor or casual staff member<\/li>\n\n\n\n<li>They operate outside Australia<\/li>\n\n\n\n<li>Permanent employees are the only exclusion.<\/li>\n<\/ul>\n\n\n\n<p>Impact: Providers must report and list all such agents on their website and in PRISMS.<\/p>\n\n\n\n<p>Mandatory Transparency of Education Agent Commissions<\/p>\n\n\n\n<p>The Department can now request detailed data on all monetary and non-monetary commissions, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Total dollars paid<\/li>\n\n\n\n<li>Value of gifts, incentives, bonuses<\/li>\n\n\n\n<li>Number of students recruited<br><\/li>\n<\/ul>\n\n\n\n<p>This includes indirect or third-party payments, which is closing the loophole in common practices.&nbsp;<\/p>\n\n\n\n<p>What are the non-compliance risks for providers: infringement notices, penalties, and regulatory action.<\/p>\n\n\n\n<p>It was reported that the PRISMS will soon display cross-provider agent performance.
