This means that, once your visa is cancelled or application refused, you would normally need to leave Australia.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Becoming unlawful in Australia or overstaying your visa can negatively affect future visa applications and eligibility for citizenship. While there are exceptions to what is referred to as the \u201csection 48 bar\u201d, applicants will need to demonstrate compelling and compassionate circumstances in order to be able to overcome it.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Visa Exceptions to Section 48 Bar for onshore applications:<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">partner visas<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">protection visas<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">bridging visas<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">medical treatment visas<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">subclass 444 visas for New Zealanders<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Child visas<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Border visas<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Resolution of status visas<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><b>As of 13 November 2021, a section-48-bar waiver is available for skilled visa applicants:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Skilled visa (Subclass 190)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Skilled visa (Subclass 491)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employer sponsored regional visas (Subclass 494)<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><b>Can I appeal the refusal or cancellation of my visa?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Yes, if the Department of Home Affairs cancels or refuses your visa, you can <\/span><a href=\"https:\/\/www.educli.com\/blog\/2024\/05\/19\/understanding-the-process-of-aat-review-for-refused-student-visas\/\"><span style=\"font-weight: 400;\">appeal the decision in the Administrative Appeals Tribunal (AAT)<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The AAT will then decide to agree with, vary, or set aside the Department\u2019s decision and make a new decision. The AAT can also resubmit the decision to the Department for reconsideration.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Often, the best way to get around a section 48 bar is to simply go offshore and lodge a new visa application while you are living in another country \u2013 however, you will need to ensure that the application is strong enough that you do not risk another refusal on your record and inability to return to Australia.\u00a0<\/span><\/p>\n<h3><b>Invalid application<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">An invalid application means that when you apply for a visa and the Department of Home Affairs decides not to process your application because it doesn\u2019t meet the valid application criteria, the application is not considered, which means that it cannot be approved or refused. If your visa application has been deemed invalid (not refused), then Section 48 bar does not apply.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>What if I have a visa and my application is refused while holding another visa?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Section 48 bar will not be considered if you hold a substantive visa despite the refusal of another visa.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A substantive visa is any visa excluding:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">criminal justice visa<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">enforcement visa<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">bridging visa<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Facing a student visa refusal and the implications of Section 48 can be challenging and disheartening.
