Education providers in Australia are responsible for ensuring that all recruitment activity, direct or through third parties (agents) is ethical and transparent. Under the ESOS Act and National Code, providers must:

  • ensure that the marketing and promotion of its courses and education services is not false or misleading; and 
  • include their Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) registered name and registration number in all written and online materials. 

Registered providers must not: 

  • provide false or misleading information in relation to course requirements when seeking to enter into a written agreement; 
  • commit to securing migration or education assessment outcomes for overseas students; and 
  • recruit students if it conflicts with its obligations under Standard 7 (Overseas Student Transfers). 

It is believed that the Australian Government is preparing a stronger regulation of education agents in the upcoming ESOS Act review. Therefore providers should anticipate:

  • Mandatory agent registers linked to compliance reporting.
  • Increased penalties for engaging with unethical or unregistered agents.
  • Stricter oversight of student transfers and visa compliance.
  • Greater data-sharing between PRISMS, ASQA, and Home Affairs to track agent behaviour.
