ESOS Amendments: When Is Agent Commission Payable (and When Is It Not)?
The latest ESOS amendments don’t just regulate commissions, they regulate the behaviour commissions create.
For providers, the biggest risk isn’t whether you pay agents, it’s what your payment structure is quietly incentivising. From mid-2026, structure, rates, and incentives must all be recorded and reported.
The shift in plain terms:
– Commissions are now a compliance matter: any benefit that influences recruitment activity, e.g. payment, bonus, gift, or discounted service, is now regulatory data, not a sales report.
The reforms target three specific behaviours:
– Churn-driven recruitment (enrolling students who aren’t suited to the course)
– Onshore poaching (agents transferring students away from existing providers)
– Opacity (providers who can’t account for what they pay, when, and why)
When commission is not payable
The clearest line drawn by the amended framework is that a commission linked to a student transferring from another provider is an explicit integrity trigger.
More broadly, if a payment structure creates an incentive to enrol students regardless of suitability or to move them rather than serve them, it falls within the scope of the new restrictions.
From mid-2026, all agent-related benefits must be reported under the amended ESOS framework. That includes:
– Commission payments
– Performance bonuses
– Marketing or recruitment incentives
– Gifts and hospitality
– Discounted or free services
If a benefit influenced a recruitment outcome, it will likely fall within scope.
What providers should be doing now
- Map all agent benefits, not just commissions
- Align admissions, finance, and marketing records
- Centralise agent agreements and incentive tracking
- Treat agent data as compliance information, not sales admin
The bottom line is that providers who map their agent benefit structures now will respond to 2026 with confidence. Those who don’t will meet it as a compliance shock.
