Why Education Agent Monitoring Is Now Non-Negotiable for Providers
Unethical and reckless conduct by education agents, both offshore and onshore, remains one of the biggest risks in Australia’s international education sector. The government has made it clear: third-party behaviour is now a direct compliance priority.
It is the providers who are responsible for the accuracy, integrity, and compliance of all marketing and recruitment activities, whether conducted by them or third parties on their behalf.
Under the ESOS Act and National Code, providers must only engage in ethical, transparent, student-centred recruitment practices.
- When enrolling overseas students, providers must not:

- Accept a student transfer within the first 6 months without a legitimate release
- Work with agents known, or reasonably suspected, to act dishonestly
- Accept students likely to breach visa conditions (e.g., transferring to lower AQF levels without a new visa)
Providers must:
- Ensure all information is clear, comprehensive, and supports informed decisions
- Report accepted students to PRISMS within required timeframes
- Ensure education agents act ethically, honestly and in the student’s best interests
- Maintain ongoing agent monitoring, training, and performance reviews
The days of passive agent oversight are over. Regulators now expect evidence of:
- Ongoing monitoring
- Quality assurance
- Agent performance reviews
- Data-driven risk analysis
- Clear corrective action when issues are identified
