Amendments to the ESOS Act
This Bill follows the Government’s previous, unsuccessful attempt to pass the Education Services for Overseas Students Amendment (Quality and Integrity) Bill 2024, which faced opposition over proposed Ministerial powers to impose student caps.
Notably, all references to enrolment limits at provider and course levels (Part 7 of the 2024 Bill) have been removed.
According to the Explanatory Memorandum:
“Parts 1–7 of Schedule 1 are substantially the same as Parts 1–6 and 8 of the 2024 Bill.”
Minor refinements have been made to clarify ambiguous terms in Parts 4 and 5 of Schedule 1.
Changes to the TEQSA Act – Offshore Course Delivery
Part 9 of the Bill focuses on transnational education, introducing new requirements for Australian higher education providers offering courses offshore.
A key change stipulates that:
“Registered higher education providers must be authorised to offer or confer Australian higher education awards for Australian courses of study provided at offshore premises.”
Additional provisions outline how providers can apply for this authorisation and what ongoing reporting obligations will apply.
This Bill marks another significant step in shaping the integrity and regulatory framework of Australia’s international education sector.
